Chapter 12 Bankruptcy

Chapter 12 bankruptcy is similar to chapter 13 bankruptcy except that it applies to farmers, ranchers and fisheries including organic growers, poultry farmers and other types of farm operations.  It also allows for a larger amount of debt to be serviced.

Under chapter 12 bankruptcy debts and payments are reorganized and filing is less complicated and less expensive than using chapter 11 which is better suited to large corporations.

In chapter 12 bankruptcy a trustee is appointed to monitor the debtor's farm operations and receive payments until the case is finalized.
