Of the thousands of lawsuits plaguing the
asbestos industry, only a small portion involve
victims of Mesothelioma. According to a study
by the RAND Corporation, the average legal award
related to a Mesothelioma case was around $6
Million. Cases settled out of court averaged a
smaller $1 Million. Congress has tried for
several years to pass legislation helping both the
victims and the asbestos industry and banning
asbestos use but so far it has not become law.
Most European countries have already passed a ban on
asbestos.
Despite the time it takes from exposure to disease
manifestation, today it is generally accepted that
Mesothelioma results almost entirely from asbestos
fiber exposure. Symptoms of the disease begin to
appear only twenty to forty years after initial
exposure. Once diagnosed, however, life
expectancy is just a few years. There is no
consensus as to the amount of exposure required to
result in contracting the disease.
Mesothelioma symptoms are similar to some other
diseases. Specifically, it is a malignant tumor
occurring in the peritoneum or pleura. Another
common disease of asbestos fiber exposure is
Asbestosis. Asbestosis is a fibrosis of the lungs.
Lung cancer itself can occur from asbestos fiber
exposure or from many other causes such as cigarette
smoke.
