A rental agreement is another term for a lease
agreement. The rental agreement provides the
terms between the landlord and the tenant concerning
the rental of the property. It includes the
amount of rent, identifies the property, identifies
the parties and specifies the term of the rental.
Additionally, a rental agreement normally will
specify in detail the rights and obligations of the
landlord and tenant. These may include:
Who can live with the tenant including visitor
duration
What utilities are included in the rent
Under what circumstances the tenant my sublet the
property
How the tenant may use the common areas and
parking spaces
The term and frequency of rental payments
Late payment charges and eviction notification
What options exist at the end of the rental
agreement
And possibly other conditions and
responsibilities
The rental agreement is bound by the laws of the
State where the property is located. Many states
provide for basic tenant rights that cannot be negated
by the contract. For instance, some States
provide for treble damages if a rental deposit is not
returned within a specified time after the agreement
ends. Other laws specify the conditions that
allow for eviction and the procedure the landlord must
follow.
